Two counts of first degree murder were dismissed on June 15, 2012, against our client, “E.F,” of Red Bank, by a judge sitting in Monmouth County Superior Court. The co-defendant, Antonio Suarez- Perez, who was convicted by a Monmouth County jury on a double homicide committed in Red Bank in February 2009, will be sentenced in July. Suarez-Perez is eligible for two life terms in prison.

Forensic evidence in the case, including gun shot residue analysis, proved the “E.F.” was not the shooter of two young Red Bank men. E.F. testified that he was present in a nearby parking lot with Suarez-Perez, and another companion, when Suarez-Perez suddenly left the car and announced that he would be right back. Shortly afterwards, E.F. heard multiple gunshots. Suarez-Perez came running back to the car and stated that he had just shot the two individuals. E.F. was initially indicted as a co-defendant in the case and was initially offered a sixty year sentence in a plea deal.

E.F., who was represented by David Schwartz of Schwartz & Posnock in Eatontown, New Jersey, was able to work out a plea deal for E.F. to hindering apprehension, which was amended to a third degree offense after the trial of Suarez-Perez. E.F. was sentenced to probation.
